Time magazine’s analysis of the NLRB ruling included a comment from Richard Hurd, professor and associate dean for external relations at the ILR School, and associate director of the center. The ruling involves the relationship between McDonald’s and its franchisees with regard to who is the employer. Although the NLRB ruled that McDonald’s is a co-employer with its franchisees, Hurd points out that the usual standard has been, as Time puts it, if a company outsources its work to another firm, that latter firm becomes the employer.
